This website and online store are operated by The Original Rum Bum Company Limited, trading as The Original Rum Bum®. References in these Terms of Service to “Rum Bum”, “we”, “us” or “our” mean The Original Rum Bum Company Limited.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and services.

These Terms of Service explain the conditions that apply when you visit our website, use our services or place an order with us. Please read them carefully before placing an order.
By using our website or placing an order, you agree to these Terms of Service and the policies referred to within them. If you do not agree, you should not use our website or place an order.
Nothing in these terms affects your statutory rights as a consumer.
3. Age restrictions and alcohol sales
You must be aged 18 or over to purchase alcohol from The Original Rum Bum®. By ordering an alcoholic product, you confirm that you are at least 18 years old and legally entitled to purchase alcohol.
You must not purchase alcohol for anyone under the age of 18. If an alcoholic product is intended as a gift, the recipient must also be aged 18 or over.
We reserve the right to refuse or cancel an order where we reasonably believe that the age requirements have not been met or where completing the order would be unlawful.
4. Using our website
You may use our website only for lawful purposes. You must not:
- use the website fraudulently or in connection with unlawful activity;
- attempt to gain unauthorised access to the website, another customer’s account or any connected systems;
- introduce viruses, malicious code or other harmful technology;

We may suspend or restrict access to the website if we reasonably believe these terms have been breached.
5. Product information
We take reasonable care to ensure that product descriptions, photographs, prices and availability are accurate. Colours and appearance may vary slightly depending on your screen and device settings. Packaging and presentation may also change from time to time without affecting the product’s essential characteristics.
All products are subject to availability. We may withdraw products, limit quantities or correct errors in product information at any time.
Images are provided to help illustrate our products. Please read the full product description before ordering.
6. Placing an order
When you place an order, you are offering to purchase the products in your basket. After placing an order, you will receive an order acknowledgement. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A contract between you and us is formed when we send confirmation that your order has been accepted or dispatched. We may decline or cancel an order before acceptance, including where:
- a product is unavailable;
- payment cannot be authorised;
- there is an obvious error in the price or product information;
- we reasonably suspect fraud or misuse;
- age requirements have not been satisfied; or
- we cannot lawfully deliver the order.
If we cancel an order after taking payment, we will refund the amount paid for the cancelled products.
Please check your order and delivery details carefully before submitting them. Contact us promptly if you notice an error. We cannot guarantee that an order can be changed after it has been accepted or dispatched.
7. Prices and payment
Prices are displayed in pounds sterling. Applicable taxes are included where required unless stated otherwise. Delivery charges are shown separately during checkout before you place your order.
Prices and promotions may change, but changes will not affect an order that we have already accepted. If an obvious pricing error occurs, we may contact you for instructions or cancel the affected order and issue a refund.
You must provide complete and accurate payment, billing and contact information. By submitting payment details, you confirm that you are authorised to use the selected payment method.
8. Delivery
We currently deliver to addresses within the United Kingdom. Delivery options, charges and estimated times are explained in our Shipping Policy and are displayed at checkout where applicable.
We aim to dispatch orders within the time stated in our Shipping Policy. Delivery estimates are not guarantees, but we will meet our legal obligations and contact you where we become aware of a significant delay.
Please provide a complete and accurate delivery address. If you ask us to send an order to another person or nominated recipient, delivery to that person will be treated as delivery to you.
Risk in the products remains with us until the products come into the physical possession of you or a person identified by you to receive them, except where you independently arrange a carrier that we did not offer.
9. Cancellations, returns and refunds
Your rights to cancel an order, return products and request a refund are explained in our Returns and Refund Policy.
If a product is faulty, damaged, not as described or otherwise fails to meet your legal rights, please contact us as soon as possible. Nothing in these terms or our Returns and Refund Policy limits your statutory rights.
10. Accounts
If you create a customer account, you are responsible for keeping your login details secure and for activity carried out through your account. Please contact us if you believe your account has been accessed without permission.
The information you provide must be accurate, current and complete. You must not transfer or sell your account to another person.
11. Intellectual property
The website and its content, including our names, trademarks, logos, text, photographs, graphics, video, audio and design, are owned by or licensed to The Original Rum Bum Company Limited and are protected by intellectual property laws.
You may view and use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.

If you submit a review, photograph, comment or other content to us, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.

We may remove content that is unlawful, misleading, abusive, offensive, infringing or otherwise inappropriate.

Our website may contain links to websites or services operated by third parties. These are provided for convenience and do not mean that we endorse or control them.
Third-party websites and services have their own terms and privacy policies. We are not responsible for their content, availability or practices. Nothing in this section excludes responsibility that cannot legally be excluded.
14. Shopify
Shopify provides the ecommerce platform used by our store. Purchases made through our store are made directly from The Original Rum Bum Company Limited, not from Shopify. We are responsible for the products we sell and for handling your order, customer-service enquiries and applicable consumer rights.
15. Privacy
We process personal information in accordance with our Privacy Policy. Shopify and other service providers may also process information where necessary to operate the store, process payments, prevent fraud and fulfil orders.
16. Our responsibility to consumers
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. A loss is foreseeable where it was an obvious consequence or where both you and we knew it might happen when the contract was formed.
We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, and your statutory rights as a consumer.
If you use products or services for commercial or business purposes, we are not responsible for loss of profit, loss of business, business interruption or loss of business opportunity, except where the law does not allow that responsibility to be excluded.

We are not responsible for delay or failure caused by events outside our reasonable control. If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to reduce the effect of the delay. Your legal rights remain unaffected.

The terms applying to an order are those in force when that order is placed, unless a change is required by law or a regulatory authority.
19. Severability and waiver
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
If we do not enforce a provision immediately, this does not mean that we have waived our right to enforce it later.
20. Governing law
These terms and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you retain the benefit of any mandatory protections that apply where you live and may bring proceedings in your local courts. Consumers in England and Wales may bring proceedings in the courts of England and Wales.
